AHA|SA Response to Draft Liquor Licensing (Liquor Review) Amendment Bill

The AHA|SA has released its response to the Liquor Licensing (Liquor Review) Amendment Bill 2016, and the Community Impact Assessment (AG Department Guideline). Please view a copy of the response below.
Please also find attached a document released by Deputy Premier John Rau, which is a summary of changes made to the Bill as a result of the consultation process.

New Gaming Self-Assessment Compliance Checklist

This self-assessment compliance audit checklist has been developed by Consumer and Business Services (CBS) to assist licensees in assessing the level of compliance with legislation, regulations, licence conditions and codes of practice for gaming and wagering.

Where the self-assessment checklist makes reference to policies and procedures, venues with Responsible Gambling Agreements in place may refer to their Responsible Gambling Document for compliance with these matters.

The Gambling Codes of Practice Notice 2013 (Codes) makes reference to a “peak body”. For the purposes of this reference and in relation to clause 10B(1)(a) of the Gaming Machines Act 1992, the Independent Gambling Authority has approved Gaming Care and Club Safe as Recognised Industry Bodies. Licensees that have a Responsible Gambling Agreement with either of these bodies are exempt from certain clauses of the Codes.

National AHA Pre-Budget Submission Feburary 2016

The national AHA has prepared a Pre-Budget Submission. The Key items from those submissions are listed below:

  • Removal of various regressive taxes should be included as compensatory measures for increases to the GST
  • In the event of any increase to the GST, that the current principle of neutrality on gambling be retained
  • The 2015 decision to abolish the tax free threshold for working holiday makers be reversed so as to encourage more backpacker tourism and assist with the supply of labour in seasonal areas particularly.
  • Restoration of reasonable entertainment expenses as a tax deduction and the removal of FBT on staff business meals
  • The recent accelerated and depreciation and reduced company tax rates be available to businesses of all sizes
  • The government ensures that it modernises the tax system to ensure it maximises tax revenue from the digital and unregulated economy, as paid by “bricks and mortar” businesses.
  • The Federal Government take action to ensure that the “unregulated share accommodation economy” adheres to the same regulatory regimes and taxation as the regulated accommodation industry.
  • The Federal Government take action to prohibit wagering with illegal offshore wagering operators so as to retain leaked wagering revenue within Australia
  • Strongly advocates retaining the existing differential rates for low, mid strength and draught beer
  • The government consider introducing differential excise rates for wine and spirit bulk alcohol products consumed on premise

Smoking

The Cancer Council of SA has launched its campaign aimed at banning smoking in outdoor ‘alfresco’ areas - where food and drink is served - including footpath and internal ‘beer gardens’.  The move by the Cancer Council is not entirely unexpected in light of moves for similar legislation in Victoria and given the SA State Election in March 2014.

The Health Minister Jack Snelling also released a Government discussion paper on 9 August 2013, entitled “Smoke-Free Outdoor Eating and Drinking Areas”.  Submissions to the Discussion Paper are due by 1 November 2013 and the AHA will be making a submission.

Small Bars (Small Venue Licence)

Legislation passed in February 2013 allows for the granting of a new category of licence, “the Small Venue Licence”. 

The State Government says this new category of licence is to “encourage entrepreneurs to develop small businesses without the potential difficulties and costs associated with existing licences.”
